Terms And Conditions of Service

1.General
This User Agreement governs the use of this Website. TCI dba ForeclosureFilter is the owner of the website and reserves the right to add, remove or modify portions of these terms at any time. In agreeing to use www.foreclosurefilter.com and or its products and services you agree to abide by the terms & conditions below.

3. Fees, Subscription to Service and Authorization of Monthly Payments
Subscription to ForeclosureFilter does not require a long term contract. Upon activation you pay  the 1st and last monthly subscription fee. Cancellation of service can be done at any time with a 30 day written notice to support@foreclosurefileter.com.   Fees currently in effect can be accessed under “Pricing”.

Upon activation of service, 1st and last months subscription fee will be automatically billed to your credit card. On going monthly fee will be charged to the same credit card kept on file or to any other credit card updated by you.  In agreeing to the terms and conditions herein, you authorize ForeclosureFilter to keep your credit card information on file and to automatically bill your credit card every month, on or around the day of the month that you initially subscribed for the service.

ForeclosureFilter monthly fee is for the use of software and purchase of active foreclosures leads. Upon activation you are provided a full month of active leads. No refunds will be made for the fees paid upon activation of your account.  You can however cancel at any time with a 30 day cancellation notice to support@foreclosurefilter.com and no further charges will made to your account.  All credit card transactions are processed through Telecom Cartel, Inc.

4.Single User Subscription
Username and password assigned to you by ForeclosureFilter is for a single system/single subscriber and cannot be used other individuals and/or shared by multiple systems/users in a company, firm or organization. You agree not to reproduce, transmit, distribute, display, sell, store, archive or publish any Licensed Information to anyone, including but not limited to others in the same company, firm or organization, without the express prior written consent of ForeclosureFilter. An additional fee as stated in “Pricing’ will be charged for the 2nd computer. 

5. Phone Number Provided
We provide borrower phone number information that has been obtained from publicly available records and as such cannot guarantee the accuracy of the phone numbers or phone numbers for every borrower. We are not responsible for the Do Not Call status of the phone numbers. It is your responsibility to comply with the current standards and regulations on making phone calls, as set forth by the governing agencies.

6.Privacy Policy
ForeclosureFilter collects information from our subscribers during the subscription process. This information ranges from data we need to validate your subscription, such as your name, address, billing information and information gathered through aggregated tracking, derived mainly by tallying page views throughout our sites. Such information enables us to better tailor our content to our readers' needs. Foreclosure does not disclose to third parties any personal information which could disclose your identity except for the purpose of collecting of fees for the subscribed service through nationally authorized transaction companies such as Paypal.

7.Cancellation
There is no long term contract for the service except for a 30 day cancellation policy. You can cancel the service at anytime with a 30 day written notice sent via email to support@foreclosurefilter.com. The service will be cancelled 30 days from the date of the email of the cancellation notice. No further charges will be applied to your account. ForeclosureFilter reserves the right to terminate this Agreement at any time for any reason, including, but not limited to, your failure to timely pay all fees and charges incurred in connection with your username and password or any other breach by you of this Agreement. Termination may be by mail, e-mail notification, or by blocking further access by the username.

8.Disclaimer of Warranties and Liabilities
ALL LICENSED INFORMATION AND OTHER MATERIAL ON THE FORECLOSUREFILTER WEBSITES (INCLUDING WITHOUT LIMITATION LEGISLATION AND CASE REPORTS) IS PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED, AND ALL SUCH WARRANTIES ARE HEREBY DISCLAIMED. FORECLOSUREFILTER, CANNOT AND DOES NOT WARRANT THE ACCURACY, COMPLETENESS, CURRENTNESS, NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF ANY LICENSED INFORMATION OR OTHER MATERIAL AVAILABLE THROUGH THE SERVICE OR THE SERVICE ITSELF. FORECLOSUREFILTER, ITS DIRECTORS, EMPLOYEES, REPRESENTATIVES, AFFILIATES AND LICENSORS SHALL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR DAMAGE, OR DECISION MADE OR ACTION TAKEN OR NOT TAKEN BY YOU IN RELIANCE ON SUCH CONTENT.

THE INFORMATION CONTAINED AT THE FORECLOSUREFILTER WEBSITE IS NOT INTENDED TO PROVIDE LEGAL ADVICE. YOUR ACCESS OF THE SERVICES DOES NOT CONSTITUTE AN ATTORNEY-CLIENT RELATIONSHIP. FORECLOSUREFILTER DOES NOT WARRANT THAT THE SERVICE IS COMPATIBLE WITH YOUR EQUIPMENT OR THAT THE SERVICE IS FREE OF ERRORS OR VIRUSES, WORMS OR “TROJAN HORSES” AND IS NOT LIABLE FOR ANY DAMAGE YOU MAY SUFFER AS A RESULT OF SUCH DESTRUCTIVE FEATURES. DUE TO THE INHERENT NATURE OF ELECTRONIC DISTRIBUTION, THERE MAY BE DELAYS AND OMISSIONS IN THE SERVICE.

If any provision in this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. This Agreement, your rights and obligations, and all action contemplated by this Agreement shall be governed by the laws of the United States of America and the State of California, as if the Agreement was a contract wholly entered into and wholly performed within the State of California.

9.Entire Agreement
This Agreement may be amended from time to time to include any other terms and conditions of service posted elsewhere on the ForeclosureFilter Website, and to which you agree, constitutes the entire agreement between you and ForeclosureFilter and governs your use of the Service.
